We provide assistance and representation in civil cases under the State and Municipalities Liability for Damages Act. We represent individuals seeking compensation from the State for damage caused by the investigating authorities, prosecutors and courts as a result of unlawful:
- Detention, including detention imposed as a preventive measure, where the detention is subsequently revoked for lack of a lawful basis.
- Criminal charges where the person is acquitted, or proceedings are terminated because the person did not commit the act, the act is not a criminal offence, or the prosecution was initiated after the limitation period had expired or an amnesty had been granted.
- Criminal conviction or administrative penalty where the person is subsequently acquitted or the administrative penalty is revoked.
- Court-ordered compulsory hospitalisation or treatment, or coercive medical measures, which are later overturned for lack of a lawful basis.
- Court-imposed administrative measures where the relevant decision is set aside as unlawful.
- Enforcement of a sentence beyond its lawful duration or extent.
- Use of special intelligence-gathering means.
We also advise and represent clients in disputes involving district heating providers, water utilities, mobile operators, banks and others.
